REAL ESTATE BROKERAGE SERVICES TERMS AND CONDITIONS
- General Information
- These Terms and Conditions set out the rules for providing real estate brokerage services by PATRYCJA KWIATKOWSKA, based in Warsaw, Poland. Contact with the Administrator is possible via email: biuro@pkwiatkowska.pl.
- The Broker operates in accordance with the Polish Real Estate Management Act.
- Scope of Services
- Brokerage services include, in particular:
- brokerage in the sale of real estate,
- brokerage in the purchase of real estate,
- brokerage in the lease and rental of real estate,
- advisory services in the real estate market.
- The detailed scope of services is defined in the brokerage agreement concluded with the Client.
- Conclusion of the Brokerage Agreement
- The brokerage agreement may be concluded in written or electronic form.
- The agreement shall specify, in particular:
- the scope of the Broker’s activities,
- the amount of remuneration (commission),
- the duration of the agreement,
- the rights and obligations of the parties.
- Remuneration
- The Broker is entitled to remuneration (commission) as specified in the agreement.
- Remuneration is due upon facilitating the conclusion of a sales, lease, or other agreement concerning the property.
- Rights and Obligations of the Parties
The Broker undertakes to:
- perform services with due diligence,
- act in accordance with applicable law,
- maintain confidentiality of information obtained from the Client.
The Client undertakes to:
- provide accurate information regarding the property,
- cooperate with the Broker,
- pay remuneration in a timely manner.
- Liability
- The Broker shall be liable within the limits specified by applicable law.
- The Broker shall not be liable for decisions made by the Client based on the information provided.
- Personal Data
- Clients’ personal data are processed in accordance with GDPR.
- Detailed information is provided in the Privacy Policy.
- Final Provisions
- These Terms and Conditions constitute an integral part of the brokerage agreement.
- Matters not regulated herein shall be governed by Polish law.
- Disputes shall be resolved by the court competent for the Broker’s registered office.
