REAL ESTATE BROKERAGE SERVICES TERMS AND CONDITIONS

 

  1. General Information
  1. These Terms and Conditions set out the rules for providing real estate brokerage services by PATRYCJA KWIATKOWSKA, based in Warsaw, Poland. Contact with the Administrator is possible via email: biuro@pkwiatkowska.pl.
  2. The Broker operates in accordance with the Polish Real Estate Management Act.
  1. Scope of Services
  1. Brokerage services include, in particular:
  • brokerage in the sale of real estate,
  • brokerage in the purchase of real estate,
  • brokerage in the lease and rental of real estate,
  • advisory services in the real estate market.
  1. The detailed scope of services is defined in the brokerage agreement concluded with the Client.
  1. Conclusion of the Brokerage Agreement
  1. The brokerage agreement may be concluded in written or electronic form.
  2. The agreement shall specify, in particular:
  • the scope of the Broker’s activities,
  • the amount of remuneration (commission),
  • the duration of the agreement,
  • the rights and obligations of the parties.
  1. Remuneration
  1. The Broker is entitled to remuneration (commission) as specified in the agreement.
  2. Remuneration is due upon facilitating the conclusion of a sales, lease, or other agreement concerning the property.
  1. Rights and Obligations of the Parties

The Broker undertakes to:

  • perform services with due diligence,
  • act in accordance with applicable law,
  • maintain confidentiality of information obtained from the Client.

The Client undertakes to:

  • provide accurate information regarding the property,
  • cooperate with the Broker,
  • pay remuneration in a timely manner.
  1. Liability
  1. The Broker shall be liable within the limits specified by applicable law.
  2. The Broker shall not be liable for decisions made by the Client based on the information provided.
  1. Personal Data
  1. Clients’ personal data are processed in accordance with GDPR.
  2. Detailed information is provided in the Privacy Policy.
  1. Final Provisions
  1. These Terms and Conditions constitute an integral part of the brokerage agreement.
  2. Matters not regulated herein shall be governed by Polish law.
  3. Disputes shall be resolved by the court competent for the Broker’s registered office.
